Back in BETA when I suggested the minimum number of races in the contract, it should have sorted this. The basic idea was that if the person was not in their contracted role for the minimum number of races over a season then they are free to talk to other teams and leave. Races that the team miss also count as a race that the person was not in their contracted role for. As a result, if a team goes bot, persons would be freed up to move. It also stopped teams from signing lots of people for one role so there was no hoarding. However, I don't think that is working as intended as I haven't seen a single person get released early through this method.
This allowed new teams to sign the top persons if they so wished but gives the game some protection. The idea of users setting up teams to steal all the top persons from rivals is covered by the rules as teams are not allowed more than 1 team. If someone did try it, they would be caught and I'm sure the persons would be released from the contracts and the user involved punished in some way.

The only thing I would add to this is if a team has been bot for a while (perhaps a season) then future contracts would be removed as well.
If the bankruptcy thing worked like it did in PW1.0, or in this case resetting vacant and non active teams, then when they were reset all current and future contracts were voided and any staff/drivers/supplier deals were released instantly.
In my first season of this game I was out on an empty division in week 7, finding my way through I only signed most of my team for 1 season at a reasonable price. Needless to say I won the championship and got promoted when trying to negotiate with my staff to keep them on some of them wanted over 10x what the original contract was plus massive increases in bonuses because they won 5 races against no one, after being promoted with bad car obviously I couldn't compete in div 2 and got relegated which I was happy about as I'd get a chance to compete against people nearer to where my team is at however I was demoted into another empty div so I get to win an uncontested championship, massively inflate my staffs demands, still have a bad car and have very little fun for the next 2 seasons.
Said it since the beginning of time - there will be bogus teams made either on purpose or by monkeys with the resulting issues of drivers being bought for silly money then being lost in limbo.
Release ALL current and future contracts as soon as a team goes bankrupt or is removed.
Give the new manager first refusal; but say he can only keep perhaps three members; or he has to re-offer within 7 days or they are free to anyone to re-sign.
so what happens now. my top driver that is leaving to go to Slincon GP a div 3 team at the end of the season for about 2 mill a week, but the new team has had his manager sacked, will he ever get to drive for his new team?
Probably not Les no, not unless the new team gets a manager but on those wages the team wont take long to fold. On a positive note by the time he goes he will be getting on so might be the perfect time to bring in a new driver.
As said before, what is stopping me setting up a new team in 5 minutes from an internet cafe at lunch?
Offer every Div 1 top driver a 10m a week wage.
Then offering every Div 2 top driver a 10m wage.
Then Mechanics. Designers...
Then going AWOL and not ever logging in again.
An IP log check might do something and ban that user/team; but it doesn't remove the damage done of removing talent out of the pool as that user or team would have no interest or be traced back to their real team.
I think there are people out there doing this on purpose.
Releasing contracts immediately solves this problem.
